The 2nd Amendment, and How Both Sides Get It Wrong. What Is the Militia?

U. S. Constitution, Article II, section 2

The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States;

This says the President of the United States is the Commander in Chief of the Militia when called into the service of the Federal Government. Otherwise it is under the control of the various States in which they live.


Definition of militia

1a: a part of the organized armed forces of a country liable to call only in an emergency.

.b: a body of citizens organized for military service.

For the purposes of this article, I am using definition b.

A group of Citizens organized by the State, for the defense of that States Citizens against domestic threats (as defined by the Governor of that State) and foreign invasion, again (as defined by the Governor, or President of the United States of America, when called into service by the President.)

The National Guard fulfils the 1a definition. I will discuss that later.

The 2nd Amendment, What does it mean?

Very few people Quote the 2nd amendment correctly, they almost always leave out the part about "A well regulated Militia, being necessary to the security of a free State,..." Few people use that phrase, including the Supreme Court, when discussing the right to keep a bear arms by individuals.

Now, let us look at possible uses of the Militia by the various States.

1 During peaceful protest, they could be deployed alongside law enforcement personnel to help prevent riots.

2 During riots, they could be used to protect private property and Citizens who get caught in the wrong place, at the wrong time.

3 State Governments do not have the resources to protect every target of a possible terrorist attack. These include, but not limited too: Public Schools, Pro-Life and Pro Abortion clinics, Churches, Synagogues, and Mosques. As well as any other place of Public or Private gathering, at the request of those gathering.

Areas the Federal Government could use the Militia

We currently have a Crises at our Southern Border with Mexico. The Militia could be used to Augment Border Patrol Agents, upon request by the Agents.

They could also, with limited training, be used to supplement TSA and Port Authority Agents as an additional layer of security at Air Ports, Train Stations, Ocean Ports.

I am confident that if the Federal Government looked, they could find many other uses for the Militia as well, ballot security during the upcoming elections.(Transportation of Ballots from polling locations to centralized locations for counting) ensuring ballot integrity.

Local Governments could benefit from a Militia as well

In New York City, during the 70's and early 80's crime on it's Subway System had risen to so much that people were scared to ride. Then there appeared on the scene a Militia organization known as the 'Guardian Angels', riding the subway's providing the Passengers with a safe commute. They did not carry weapons, but the were credited with reducing crime in the areas they Patrolled. Although, they did have the habit of rubbing the police the wrong way, none were ever arrested. In fact, one of the founding members, Curtis Sliwa, is using his time as a leader in the 'Angels' to promote his bid as the Republican Candidate for Mayor of New York City.

The Militia, individuals from the various 'high crime' neighborhoods of NYC could be affiliated with local Law Enforcement Personnel to help build a bridge of trust between the NYPD and local residents.




Advancements in firearms since our Republics Founding

When our Republic was founded in 1776, the standard weapon of the infantry men in any Military's around the World was the Flint locked, muzzle loaded, musket. This is the same weapon that the Militia would have faced on the battlefield. Since then, there have been major advancements in the firearm. We went to the revolver and lever action breech loaded rifle, and now we have semi-automatic pistols capable of holding clips with 9-14 rounds per, as well as semi- and fully-automatic rifles with magazines that can hold 14 rounds of ammunition, or more depending on design. Fully automatic versions should not be accessible to anyone except fully trained military personnel, and specially trained members of the Law enforcement community. Unfortunately, there are many criminals in our communities today that have access to illegally purchased fully-automatic firearms. For Politicians to say that our Militia should only be allowed to carry Muskets is, well, very uninformed.

The Militia has always, and always will be, an integral part of a Free State and Republics 1st line of defense.
