Gov. Abbott To Invoke Invasion Clause

Texas Gov. Greg Abbott announced recently he will invoke the invasion clause of the U.S. Constitution. The action will be in response to illegal immigration into the state.

First Major Act Since Re-election

Invocation of the invasion clause will be Gov. Abbott's first major action since he was re-elected to the governor's mansion for the third time last week. Abbott defeated Beto O'Rourke.

Abbott Says Two Million Tried To Enter Illegally

In his letter to the White House Abbott said more than two million immigrants tried to enter illegally in the past year. He further said they came from more than 100 countries around the world.

Letter Criticizes Administration Immigration Policy

The letter also contained strong language attacking Biden's immigration policy.The Texas governor stated, ""The administration has willfully ignored the ongoing mass influx of illegal immigrants into the country's southern states."

Border Most Dangerous Crossing in the World

Abbott's letter further alleged a United Nations agency declared the U.S.-Mexico border "the most dangerous in the world. The language specidfically stated that, "Worse yet, your failed border policies recently prompted a United Nations agency to declare that the border between the United States and Mexico is the most dangerous land crossing in the world."

What Does Invasion Clause Mean?

What exactly does Abbott's invocation of the immigration clause mean?

It will allow the governor to activate the National Guard and Texas Department of Public Safety personnel to safeguard the border and turn back would-be migrants from ijllegally crosiing the border.

Abbott Will Deploy Gunboats

The governor will also deploy gunboats to the southern border. This action is reminiscent of a historic action taken by former President Teddy Roosevelt during his administration when he declared he would send a fleet of the United States Navy around the world.

When the U..S. Congress failed to allocate the funds to send the fleet Roosevelt figured out a way to accomplish his goal. He had enough money to send the fleet halfway around the world. He said, "If Congress wants to bring the ships back to the U.S. they can find the money to do so."

Congress had no choice but to come up with the money.

Abbott To Designate Cartels As Terrorists

As part of his defense of the border Abbott has also claimed he will designate the Mexican drug cartels as foreign terrorist organizations. The cartels have reportedly been crossing the border to transport illegal drugs into the United States.

Abbott Accuses President of Open Border Policy

Abbott's letter further accused the President of an open border policy.

He said, "Your open-border policies, which have catalyzed an unprecedented crisis of illegal immigration, are the whole cause of Texas having to invoke our constitutional authority to defend ourselves."

U.S. Constitution and Texas Constitution

Abbott said both the U.S. Constitution and the Texas Constitution have invasion clauses which give him the authority to combat "overwhelming illegal immigration into the U.S. The invasion clause Abbott referred to is Article IV, Section 4 of the U.S. Constitution, which states that the U.S. "shall guarantee every state in this Union a republican form of government and shall protect each of them against invasion."

The Texas Constitution Article 4, Section 7 also states that the governor, as commander in chief of milolitary forces, "shall have power to call forth the militia to execute the laws of the State, to suppress insurrrections, and to repel invasios."

Executive Order

The recent announcement by the governor appears to back up an executive order he previously issued earlier this year. That order allows Texas law enforcement to return illegal immigrants apprehended in the state back to the U.S border.

Abbott Concerned About Smuggling Over Border

Abbott has expressed his concern about smuggling over the border. He said when he issued his executive order, "The cartels have become emboldened and enriched by President Biden's open border policies, smuggling in record numbers of people, weapons and deadly drugs like fentanyl."

Abbott Has Sued Biden in Supreme Court

The State off Texas under Abbott has sued the Administration over Biden's immigration policies. Texas has argued before the Supreme Court in a bid to stop the unraveling the Remain in Mexico Policy. So far that bid has not been successful.

However, Texas has been successful in a lawsuit to stop the narrowing of immigration and Customs Enforcement priorities by the Bidden Administration

Could Abbott and Biden Meet in Presidential Election?

Is it possible Abbott and Biden could continue their fights over immigration in the next Presidential election?

Abbott placed himself in a strong position to run for President with his re-election to a third term as governor of Texas. He defeated Beto O'Rourke recently.

Biden has indicated he may run for re-election following the unexpected showing by Democrats in the midterm elections.
