The Legal Term ‘Illegal Alien’

The U.S. Code is a collection of all the laws of the United States. Title 8 of the U.S. Code is entitled "Aliens and Nationality." The term ‘Illegal Alien’ is used 33 times in immigration law. The word 'Alien' appears hundreds of times.

Democrats object to the word 'alien.' There is nothing wrong with it. Federal law 8 USC § 1101(a)(3) defines it as “a person who is not an American citizen.” An ‘illegal alien’ is a person who is in the United States without permission, according to United States Code, Title 8, §1365(b). It is a crime to cross our borders without permission. It is a crime to work in America if you are an illegal alien. It is a crime not to leave if you have no authority to stay.

To clarify, an alien is any person who is not a citizen of the United States but is inside its borders. An immigrant is a person admitted to the United States as a lawful permanent resident. An illegal alien is in the United States unlawfully. Aliens – whether legal or illegal – are not "immigrants." Federal Law defines an "immigrant" as “a person granted the status of permanent legal resident."

Interestingly, Subsection (f)​ of 8 U.S. Code § 1182 declares, "Whenever the President finds that the entry of any aliens or any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate."

Democrats now claim that to say or write (or think) the term "illegal alien" is "racist." Of course, they claim anything against their ideology "racist," so we are not surprised. This year, illegal aliens have been caught crossing the border from over 100 countries of ALL races. I am not aware that anyone has wanted some let in and others kept out because of their race. The claim of racism is as phony as a three-dollar bill.

I might add Obama's DREAM act is an acronym for "Development, Relief, and Education for Alien Minors."

What is the Origin of the Term ‘Undocumented Immigrant?’

The politically correct phrase invented out of thin air used ubiquitously today by Democrats, undocumented immigrants, has no legal basis. It is simply a euphemism used by those who support open borders and amnesty and citizenship for illegals so that they can vote in our elections. It gives the impression that sneaking across our border is no big deal. Like they were fishing without a license or parked in the wrong place. As if it is the government's fault for not giving them the 'documents' they lack, instead of their fault for willfully with malice aforethought committing a crime.

The Associated Press and New York Times led the way by revising their guidelines to censor the words “illegal alien,” “alien,” and “illegal.” “Undocumented immigrant” was the new politically correct term. The Times declared that they intend to "avoid the sinister-sounding word 'alien.'" Who knew?

As the Federation for American Immigration Reform points out, "Regardless of intent, the term 'undocumented immigrant' is incorrect on its face because illegal aliens are foreigners (i.e., aliens) who are unlawfully present in the United States (i.e., illegal). 'Immigrant,' as used in the Immigration and Nationality Act and related statutes, is a legal term that refers explicitly to an alien who has completed the process of applying for lawful permanent resident status, has been granted permission to reside in the United States permanently, and has been issued a document confirming that status. Therefore, it is legally and logically impossible to be both an immigrant and illegally present in the U.S."

New York City passed a law that makes it illegal to use 'illegal alien,' subject to a $250,000 fine. City Hall's Commission on Human Rights gave their reason: "'Alien' — used in many laws to refer to a 'noncitizen' person — is a term that may carry negative connotations and dehumanize immigrants, marking them as 'other.' The use of certain language, including 'illegal alien' and 'illegals,' with the intent to demean, humiliate, or offend a person or persons constitutes discrimination."

Democrats do not like to distinguish legal from illegal, right from wrong, moral from immoral, and true from false.

The current Democrat White House has ordered Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP) to stop using “illegal alien,” “alien,” and “assimilation.” Aliens must be referred to as "noncitizens" or "migrants." Illegal aliens must be called "undocumented noncitizens" or "undocumented individuals." Of course, “Undocumented” disguises the fact that these people snuck into our country illegally and are trying to remain here illegally.

An Illegal Alien is not a Sojourner

Many Atheists on social media throw up the Bible, that they do not believe in, at Christians, pointing out that it says to be kind to ‘strangers ‘or ‘foreigners.’ That word, in the original Hebrew, is better translated as 'sojourners.' There is a difference between being kind and hospitable to a sojourner - someone passing through in a nomadic society - and someone sneaking across your border - a deceiver and lawbreaker - to live at your expense. God made no law saying a nation could not have borders and immigration laws. Without them, it isn't a nation at all.

As Milton Friedman says, you can have open borders or a cradle-to-grave welfare state but not both. One survey shows that 800 million people from around the world would move here today if they could, from the Third World, most with meager cognitive abilities and little skills or education. If they do, America will not be America anymore. We will be a Third World country ourselves, full of crime and disease and Balkanized.

And as for the 'big-hearted Democrats,' they could not care less about those illegal aliens. They see them as voters who will put them in permanent power, which they will use to virtually enslave us and saturate us with evil.

Up to 90% of would-be Third World immigrants would vote for Democrats. And why wouldn't they?

If one politician says, "You can come here, but you'll have to stand on your own two feet and pay your own way by competing with American workers," but another says, "Come up here and vote for me and I'll give you FREE everything, all paid for by working Americans: housing, clothes, food, education, college, phone, transportation, and even move you ahead of Americans with immediate Affirmative Action if you want to work! And there is no need to assimilate because I am for multiculturalism! And I'll say anyone against my schemes is unchristian and racist and xenophobic!"

Of course, somehow who doesn't know our language, is not very sharp, has no skills or education will vote for the Communist candidate out of his own self-interest. Who could blame them?

Why don't we help these poor people where they are? We don't have to let them move here to help them.
