Do We Live In A Police State? Is The United States Under Martial Law? Is The Constitution Still A Valid Document?

We Are In A Police State

Just the thought that the United States of America is in fact a Police State would shock many of the countries' citizens. I did not think this was ever a possibility in OUR great country, but recent events and actions have changed my way of looking at things. I was always under the belief that our Constitutional Rights could ever or would ever be openly violated by the entity calling itself our Government.

The accumulation of evidence pointing to a Police State is a list that is growing almost on a daily basis. Let us start with the groping and molestation of minors being performed by TSA agents. It would make much more sense to demand that airline providers supply the necessary security procedures to keep our air travel safe. After all it is in the best interest of the airlines that their customers feel and are safe using their services. The airlines hold the financial interest in providing safe and secure travel for their customers.

Police State?

If the airlines are unable to meet their security obligations and the Government has to uphold these security measures then you would think that the People would still maintain their Fourth Amendment Right against unreasonable searches. There is quite a difference between walking through a metal detector which is a reasonable search to having to stand virtually naked as a submissive sheep before Government Agents. Refusal of the nude scan instead gets you a feel up which would be criminal and would be defined as sexual battery in the Criminal Justice system. The same thing done to minors equates to child molestation in every State of our Union.

A couple of decades ago if you were told that these things would happen to thousands of people on a daily basis including minors, the elderly and the handicapped you would have thought it an impossibility. To make matters even worse is that these security arrangements are nothing more then a facade to appear that safety is being upheld. When it comes to a time that residents of the U.S.A. have to fear being sexually abused by servants of the People due to mandatory rules just to travel through the air. Well Then?

You are living in a Police State!

Are We Still Free? Police State out of control!

SWAT Teams In The Police State

There has also been a change in the operations of our Police Force. They have become militarized to the point of observing Law Abiding Citizens as some kind of resistance movement against the Government.

The number of no-knock raids has increased for reasons that does not seem to require the issuance of such a warrant. The Police will get a no knock warrant for everything from simple marijuana possession to suspected student loan fraud.

Our Supreme Court is an accomplice to these actions by destroying the Fourth Amendment, allowing another piece of the Police State puzzle to be put in place.

Often in these raids, immediately upon entering a human beings domain through force, the SWAT teams will execute any animals in the home. It does not matter how your dog behaves this "puppycide" is a routine standard operating procedure.

What happens many times is that the Officers serve their no-knock warrants on the wrong residence. This is a terrifying experience to an innocent home dweller, to have their domain invaded by a group of armed thugs. It is also a traumatic experience to these same innocent people when their dogs are killed due to human error on the Polices part.

When innocent American citizens fear the Police. and have their homes invaded due to errors. When Police cause harm to civilians and their pets!

Police Brutality: Cop Kills Dog For No Reason, Dept. Tries To Buy Owner's Silence

Examples of the Police State and Police Officers that have made grievous mistakes.

The reported of an incident in Delkab County Georgia where Police Officers were responding to a call of a domestic disturbance.. Although the Police went to the wrong home, the family dog was killed. The owners of the German Shepherd are justifiably angry yet there is very little they can do to remedy the situation.

When interviewed by WAGA-TV the owners made the following statement. ”When I opened the door I started screaming, I said this dog has been shot. I saw nothing but blood… he killed that dog." the dogs owner also stated ”It frustrated me because he was so quick to kill the dog.”

The two year old GSD was chained when the Officer entered the home. The Police Officer used the excuse that he felt threatened by the family pet. The worst part of this story is that in fact the Police was conducting an investigation at the wrong address. The call was received from an address across the street from the victims.

Yet another despicable error.

NBC Philadelphia reports of another incident that occurred in a West Philadelphia residence. The Philadelphia Police were executing a search of a suspected drug house. Upon entering the residence one of the Officers shot and killed the family dog.

Claiming that the dog had bitten him on the ankle the Officer fired his gun four times leading to the death of the dog. The atrocity is that the Officers were at the wrong residence. The incident occurred on the 4200 block of Pennsgrove Street. The home they were supposed to be searching was next door to the victims home. The Officer was taken to the hospital yet his condition is unknown.

Iraq War veteran shot to death in his home due to Police Officers once again arriving at the wrong home!

The case of Jose Guerena was reported in the Huffington Post.

It was 9:30 a.m. on May Fifth that Pima County Arizona Police Officers from four different Law Enforcement agencies raided four homes during an investigation in to Marijuana trafficking. The Officers arrived at the residence in full SWAT gear riding in an armored personnel carrier.

Marine murdered by SWAT at home Tucson, Arizona

Jose Guerena and his wife Vanessa Guerena owned one of the homes that the Police searched that morning. Also in the home at the time of the raid was the Guerenas four year old son. They also had a six year old that was at school on the day of the atrocity.

Mr. Guerena, a former Marine that had just completed two tours of duty in Iraq armed himself with an AR-15 rifle when the SWAT team forced their way in to his residence. The veteran told his wife to take their son and hide in a closet.

The confrontation occurred at the end of a long hallway which was in the dark. Mr Guerena was waiting in the hallway when the Police entered his home. The Police immediately opened fire on Mr. Guerena shooting at least seventy rounds in seven seconds. At least sixty of these rounds struck Jose Guerena. The Iraq war veteran was pronounced dead just an hour later.

When there comes a time that law abiding innocent human beings have a life threatening fear of having their door broken down during the middle of the night.

When this fear comes in the form of armed representatives of the State invading a home of people who have committed no crime. When these same Officers cause harm and even death to innocent citizens.

We are living in a Police State!

Stand Up To The Police State!

Although Martial Law has not been declared, the actions of the Police show otherwise.

Although Martial Law has not been declared, the actions of the Police show otherwise.

Border Patrol and State Police

The Border Patrol have been working in conjunction with the local State Police to set up road blocks twenty to thirty miles from the American borders. This in itself is not an unusual occurrence and is justified to make sure that you are not a threat to the PEOPLE of America.

There are also cases of Canadian Officers stopping Americans on American soil and treating the people as if these Officers have any authority or jurisdiction to stop and harass the PEOPLE. It is a Constitution free zone when these actions are allowed.

They would ordinarily just gaze in to the vehicle and allow you to pass through without a problem. Now these same roadblocks are manned by several Officers which are all heavily armed. Now it is a reality that you are questioned by these Officers as if you were a suspect in a crime.

Now you are asked questions such as "From where are you coming from?" or "Have you come from out of State?". They also ask if there is any luggage in your trunk? Some times they will ask you to step out of the vehicle and perform a search without any form of search warrant. It often happens that you are requested to provide Identification.

When Law abiding American citizens are required to stop their vehicle while driving through their own State and obligatorily demanded to report on their destination and where they have come from without any probable cause.

This is the actions of a Police State!

Listen To This Story!

This video is a gentleman telling his story of the actions of the Police State. A first hand account of how our Constitution is meaningless when it comes to areas of the Country that are close to the border. This includes both coasts as well. There is a twenty to fifty mile radius circling our Nation that is virtually a Constitution Free Zone.

We Need To See your Papers!

It has come to a point that American citizens of Hispanic descent or any other ethnicity are questioned as to their legal status. Border Patrol agents will stop buses, trains and other vehicles for no other reason then to question the status of the People travelling in the vehicle.

They do this in what can only be called an inquisition type manner. When there is a time that American Citizens cannot travel freely within the borders of the United States (Their Country) without having on their person "papers" proving their legality of residence or their citizenship.

This is a Police State!

Why Would We The People Allow Our Nation To Become A Police State?

Is it wrong to question authority? Do we still hold any Rights promised to us by the Document known as the United States Constitution?

Why are Police Officers and Border Patrol agents engaging in these unconstitutional activities in the first place? Are they trying to find immigrants entering the Country illegally? Is it drugs that they are searching Citizens vehicles for on the chance that they may be transporting contraband?

Or is all this done because they are trying to stop, detain and identify possible terrorists, or terrorist activity? Could this all be occurring due to the Statism which is rampant throughout the American society? Is it Statism that has brought us to this point.

What Is Statism? Is Statism Destroying Our Nation!

What Is Statism!

Statism Is the theory that economic and political power resides in the Government. This results in a submissive position for the individual human being and the communities that they occupy, in relation to the Government!

Whether it is a fear of foreigners in our society or a non-rational fear of drug use. Combined with the frenzied fear of "terrorists" lurking around every corner that is promulgated by our Government, or a collection of all three which is the stimulation that the Police State exploits.

The truth of the matter is that a Police State cannot exist without a high number of the population living in some kind of fear. These are the people that will happily trade their Freedoms and Liberties in the hope that they can hold a false sense of security.

The NDAA Law! The end of our Rights!

While many allegations of Police brutality have been revealed recently, especially at the Occupy Wall Street protests. The Police have been documented showing Police hostility towards the protesters. While these incidents are being reported the United States Federal Government passed the National Defense Authorization Act, a Law that openly creates a Police State!

This NDAA Law has transformed the United States of America in to a perpetual battlefield. This Law destroys the concept of posse comitatus as well as habeus corpus and will allow the American military to indefinetly detain any American citizen that is suspected of being a threat.

Definition of posse comitatus - Is a Federal Law of the United States of America which prohibits the American military from conducting actions that maintain Law and Order on property not belonging to the Federal Government.

Definition of habeus corpus - It is a judicial mandate which requires that a prisoner be brought before a Court to make a determination of whether the Government holds a Right to detain a suspect.

Both Democrats and Republicans proposed multiple Amendments which would have obliterated any provisions that would permit the indefinite detention of the American citizens. The majority of these proposed Amendments were quickly voted down. There was one compromise Amendment that was passed to attempt to alleviate the fears of the American populace. Its language was intended to suppress the fears of Americans who are concerned with the chance of an indefinite detention of the People. Even with this Amendment skeptics are still uneasy with the final result.

When American citizens are detained with no charges and no trial!

What does the Law do?

Constitutional scholars have stated that sections 1031 and 1032 of the National Defense Authorization Act will do the following:

(1) The Law will specifically give the Federal Government the authority to imprison American citizens without charges or the Right of a trial. The Law also allows the Government to detain others both within the borders of the United States as well as outside the jurisdiction of the United States.

(2) The Law would also authorize the military detention of citizens that would not normally fall under the jurisdiction of the military, this would also include civilians that are detained within the borders of the United States.

(3) The NDAA Law will transfer authority to the Department of Defense to engage in the prosecution, investigation, law enforcement, penal as well as custodial authority and duty which was previously held by the Department of Justice.

Origins of the NDAA Law!

S. 1867, also known as the National Defense Authorization Act was written by Senators John McCain and Carl Levin, this provision makes the declaration that American soil is a battlefield. This Law gives the President and future Chief Executives the authority to arrest and hold in detention American citizens, whether they are innocent or not, without being charged with a crime or given the chance of a fair trial.

Basically when the President signed this bill in to Law, it allowed the Government to arrest and detain indefinitely, American Citizens. These arrests can be done by the military, ignoring the Right to Due Process as well as eliminating the Right to a speedy trial.

There were two Senators that proposed Amendments to the NDAA Bill prior to the passage of the bill that would have resulted in the alteration of the bills more menacing provisions. Mark Udall (D), Senator from Colorado proposed an Amendment which would have cut out certain provisions concerning the way terrorist suspects are handled. Rand Paul (R) Senator from Kentucky proposed an Amendment which would have removed Section 1031 from the legislation. Neither one of these Amendments was incorporated in to the legislation. Senator Udalls Amendment was rejected by a majority of the votes.

When a Government takes actions which would hinder the Freedom and Liberty of its citizens!

Obama Signs NDAA Martial Law

Anonymous & National Defense Authorization Act

Senator Dianne Feinstein makes two proposals!

Also proposing Amendments to the NDAA bill was Senator Dianne Feinstein of California, she tried to limit the mandatory military custody for terrorist suspects apprehended outside the borders of the United States. Her Amendment was also rejected by a majority vote.

The other Amendment which was proposed by Dianne Feinstein was also denied by the majority in the Senate. This proposal would have forbid any indefinite detention of American Citizens without being charged with a crime or refused a fair and speedy trial.

Senators Dianne Feinstein and Lindsey Graham managed to get an Amendment passed. This Amendment states:

“Nothing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States or any other persons who are captured or arrested in the United States.”

This compromise Amendment passed easily with only one vote against it. The only vote against the Amendment was cast by Senator Jon Kyl (R) from Arizona!

Obama Signs Martial Law Bill: NDAA Now Law

Presidential Veto!

Barack Hussein Obama had stated that he would veto the Bill due to the section on detentions. He claimed at the time that this portion of the Bill would be an obstacle to Counter Terrorism agents in both Law Enforcement and the Military. Betraying his word, President Obama signed the Bill in to Law on the Thirty First of December. While most Americans were celebrating the New Year, the President placed his signature on the Bill.

Whether or not the NDAA bill is Constitutional is yet to be decided. The detention of American Citizens without any charges or a trial goes against the Bill of Rights. Those that opposed the Bill stated that the Constitutionality of the legislation would be decided by Judges, not Politicians!

Sen. Dick Durbin (D) from Illinois, was steadfastly opposed to allowing the military to have jurisdiction over American citizens within the borders of the United States.

Senator Durbin made the following statement:

"To this day the Supreme Court has never ruled on whether it is constitutional to indefinitely detain a U.S. citizen captured in the United States. Some of my colleagues see this differently, [but] the language we've agreed on makes it clear," he also added "The Supreme Court will decide who can be detained; the United States Senate will not,"

There was one Amendment that was passed without any dissent. This Amendment. proposed by Senator John McCain allowed for an expansion of cyber-security between the Department of Defense and the Department of Homeland Security. To put it another way, not only is the United States a battlefield, the Internet is as well!

While debating on the floor of the Senate, Senator Rand Paul challenged Senator McCain by asking, “Would it be possible that an American citizen can then be declared an enemy combatant and sent to Guantanamo Bay and detained indefinitely?”

Senator McCain answered Senator Pauls challenge by stating that:

“As long as that individual, no matter who they are, poses a threat to the security of the United States of America, should not be allowed to continue that threat.”

Judge Andrew Napolitano, a pundit on FOX news said that Senator McCains statement was “nonsensical and unconstitutional.”

James Madison, the primary author of the United States Constitution warned the People of America:

"The means of defense against foreign danger historically become instruments of tyranny at home"….

Historically during times of war, there has always been a danger to the preservation of our Constitutional Liberties. Any Rights which are taken from the People cannot be counted on to be returned. If we give up our Right to Due Process, there is little chance that this Right will ever be reinstated!

Congress opens US airspace for drones!

FAA Reauthorization Act, The Eyes In The Sky!

President Obama signed the FAA Reauthorization Act in to Law on February Fourteenth 2012. this Law orders the Federal Aviation Administration to establish regulations concerning the testing and licencing of commercial drones by the year 2015.

Advocates of privacy Rights say that these measures will end up with the widespread use of unmanned drones to be used for electronic surveillance by Police Agencies nationwide Eventually private companies will be using the technology as well.

Steven Aftergood. who is the head of the Project on Government Secrecy at the Federation of American Scientists said that, “There are serious policy questions on the horizon about privacy and surveillance, by both government agencies and commercial entities,”

The Electronic Frontier Foundations attorney Jennifer Lynch said she is also “concerned about the implications for surveillance by government agencies, ” she also stated that the legislation is the result of a “a huge push by lawmakers and the defense sector to expand the use of drones in American airspace,"

By several estimates, the use of commercial drones could create a market that is worth several hundreds of million dollars, as soon as the Federal Aviation Administration gives the authority for their use. The experts also estimate that upwards of 30,000 drones could be regularly used in the Nations skies by the year 2020.

Up to this point in history, the unmanned drones are a high profile tactic used by the Central Intelligence Agency in their unarmed Predator drone program. These unarmed Predator drones have been used in the "war on terror" to target Al Qaeda leaders. The majority of unarmed drone missions have been used for surveillance purposes. Some of these drones are no bigger then small radio controlled model air-crafts. There are other drones which have a wingspan that is as big as a full size jet airplane.

Within Afghanistan, the utilization of these drone airplanes have increased at such a rapid pace that there has been created piles of video materials that are yet to be analyzed.

This legislation will order the Federal Aviation Administration to accelerate the operations authorized by Federal, State, and local Police as well as other agencies by the end of the year. The Federal Aviation Administration has the power to issue certificates which will cover flights by multiple aircraft in a specific area. This will be done on a case by case basis.

The Department of Homeland Security is the only Federal Agency which openly discusses their use of unarmed drones within the boundaries of United States airspace. Operating over nine drones is the United States Customs and Border Protection, these drones are modified versions of the Central Intelligence Agencies horrifying Predators. These aircraft are flown by remote using over eighty qualified pilots. The drones are used for active participation in border and counter-narcotic surveillance under four long term Federal Aviation Administration certificates.

Government officials state that unarmed drones can be used for multiple reasons such as public-safety and emergency-management missions. A separate certificate would be needed to be issued to engage in further missions.

Mr. Aftergood was the plaintiff in a Freedom of Information Act lawsuit against the Central Intelligence Agency. Mr Aftergood made the following statement concerning the use of drones in the United States Airspace, “It’s not all about surveillance,”

When our privacy is eradicated by the use of cameras in the sky under the Federal Aviation Administration Reauthorization Act, watching our every move using unarmed drones.

We have become a Police State!

Open Your Eyes: Obama Signs NDAA Martial Law! (Civil Liberties Are Being Taken)

Have The Terrorists Destroyed Our Nation?

Since the atrocities that occurred on September 11, 2001 the greatest threat to residents of the United States is not radical terrorist organizations. Nor is it crazed domestic terrorists that is the greatest threat to the People.

The worse threat to the American citizen comes in the form of heavily armed men/women in their blue uniforms. They wear badges and body armor and make claims as to their authority over the individual. The weapons they use are not weapons of mass destruction.

It is the State approved firearms. It is the latex gloves, combined with a fundamental dismissal of our Human Rights that makes up the most grievous of threats to the People!

This Police State will continue to grow if left unabated. The Government will disregard any of our fundamental Human Rights if left to their own devices. The time has come!

Nothing will stop these senseless acts until "WE THE PEOPLE" unite and insist that our government exists to serve and protect the people. Not the other way around. These actions will continue until the time that the people tell their government that they have had enough of these Police State actions

The actual terrorists can claim victory through the destruction of any resemblance of the Rights guaranteed to us through theConstitution! The America that we once had is gone, it has been replaced by a Police State that will grow larger and larger if left unimpeded.

All is not lost, YET, but the People of America need to have our grievances redressed. We must reign in our Government now before it is too late and all we are left with is the POLICE STATE!

Stand your ground! Speak up! Tell your friends and family. Tell anyone that will listen!

We do not consent to live in a Police State!

Take the poll!

Evidence of Police State USA:

The FBI parades Mafia murderers around the FBI academy for the education of their agents, police, etc. The Mafia serial killers (hit men) are homicidal sociopaths and are often in the witness protection program; the FBI learns from them how the mafia uses violent, deadly and inhumane practices against Targets.

Never co-operate with secret services. The first thing they do is turn you into a murderer (by making you accessory to their crimes).

As we are born into a complex world that changes from moment to moment in terms of advances in technology, science, law, and contemporary standards for human conduct, no single individual can keep abreast of all the strictures (or expectations) that are brought to bear on our modern lives; even though we may think that we are experts in our own culture, we are not. Medical doctors do not know all the answers associated with causes for illnesses and diseases; lawyers often have no fast clue to finding remedies for legal issues that evolve from fast changing social mores; engineers and scientists must forever adjust design and focus of their work to deal with ever changing technologies, new discoveries and emerging societal forces and human needs.

The average individual human being may at times find himself adrift in an unfamiliar and alien sea filled with incalculable dangers. We have discovered that we cannot always cope with the stresses that we encounter on a daily basis. Returning war vets, or otherwise traumatized persons sometimes seek advice, treatment and comfort to ease medical conditions or psychological pressures. When no effective assistance is available, some of our fellow citizens may suffer, collapse and die, even while we watch on some popular cop or quasi news shows. In extreme cases the confused or disoriented citizen is imprisoned, tortured, forced into suicide, or shot dead by the very same government agents who pretend to defend our liberties.

This is an important point because no one among us is immune to neurosis when tragedy strikes. We should therefore reconsider our societal relationship with those we condemn (to prison or death), lest we abruptly someday join their numbers. Actions against a citizen by government agents and their citizen action committees often provoke the Target into wild conduct; such intentional assaults are intended to cause the Target to respond violently so that he may be arrested or killed.

We see examples of this on our streets almost daily; and I have presented numerous instances of such intentional provocations in many of my reports. Further, no attention is focued on psychological operations against a targeted person even though a growing number of persons worldwide now testify that they are targeted by ruthless and painful campaigns. No law exists that may stop the type of violent activities in which the FBI and the CIA engage regularly against their Targets, foreign and domestic. Even civil court judges routinely ignore the criminal actions of police and FBI against the accused. Thus the person portrayed as a madman on some TV shows is in reality a product of a corrupt public policy standard that authorizes the torture, imprisonment and killing of a given Target.

We must open all fbi/cia files in order to understand the total corruption of these two groups of homicidal sociopaths and how they blackmail all other branches of gov, including congress & courts.

What is the victory scenario on the "War on Terror? Is it to continue forever and this Nation will never hope to see Peace again if classified as a war zone?

Perhaps I am not explaining myself properly. I am saying that even an American citizen that takes arms against this country, or one who is just a "terrorist" should be arrested and detained. The current system cannot handle them. Show me the penal code they violated. Easy and I will save you the trouble, there is not one. Hence why the upper court in the Padila case changed the sentence stating" the sentencing guidelines are to leanient for this type of crime". That is because they charge him with a crime that had nothing to do with what he truly committed. That should have been a wake up call, but it was not.

Once more, I ammsaying we need to create a category of laws and be real specific on this issue. I have no problem letting the military try them in their court system. The accused gets a lawyer like in our system.

Would you not consider the US a war zone? What would you classify 911?

Reality Bytes (author) from Freeman On The Land United States of America. on December 30, 2011:

Something to ponder:

Do unto others as you would have them do unto you!

If we can indefinitely detain a human being on suspicion without any requirement to provide evidence of criminal activity what would stop other Nations from doing the same?

Would it not be a repercussion if American citizens found themselves in the same situation as American "enemy combatants"?

Detained indefinitely with no evidence of wrongdoing. Especially if that person had military training. Do we want our citizens to share the same fate on foreign soil?

Under international law, what would be our recourse against such actions? Would we cry foul if such incidents occurred. Any American traveling abroad could be whisked away never to be seen again. No chance to talk to an American consul and no day in a Court of Law.

The United States of America does not hold any superiority under International Law. Why do we think we do?

What if another Nation declared the Government of the United states to be a terrorist organization? What if they produced a deck of cards with pictures of members of our Government upon them? What if they determined these people to be assassinated?

What actions would we implement to stop such activity? That is a path that I would not want to travel? What if the members of our military were captured in a Nation that is not a designated war zone? Would we want that Nation to treat them the same way we treat our "enemy combatants"?

I support the rule of Law! I support our Constitution! I love my Country, I respect our men/women in uniform!

To insure their safety I want our government to take in to consideration the reactions to our actions. If a human being is a suspect to a crime then I want the Law of the land to remain in effect. I want them punished but I want it done in the same manner as any other criminal.

Our Laws are just and they should be enforced. The burden of proof lies on the Government. Suspicion of future criminal activity does not justify disregarding our Laws and detaining a human being indefinitely with no chance to redress their grievances.

I do not wish to exchange our Liberty for a sense of safety as this will lead to us losing both!

Reality Bytes (author) from Freeman On The Land United States of America. on December 30, 2011:

I agree AV, but our Constitution should have been enforced. He should have been arrested and faced prosecution under common law. Which was the inevitible outcome of the case. No where in the Constitution is a person arrested on U.S. soil not allowed the ability to retain their human rights.

It has created a dangerous precedent. Every human being is equal under the Law. There is no sub-human designation.

By detaining an individual without due process, the very basic elements of the American society is denigrated.

It is the actions of a Police State.

American View from Plano, Texas on December 30, 2011:

While tru he was born in the US, the article does not talk about him giving his US citizenship up. He married an Egyptins lady.

U.S. authorities accused Hassoun of consorting with radical Islamic fundamentalists, including Al-Qaeda. Hassoun was arrested in 2002 for overstaying his VISA( If he was a citizen, I wonder why he would need a Visa)[5] and was charged in 2004 with providing material support to terrorists( ath the time of his arrest he had in his pocket a list of known terroists and their cells in the US).[6] By that time Hassoun had already been charged with perjury, a weapons offense, and other offenses.

Padilla married an Egyptian woman named Shamia'a and had two sons who were infants at the time he was arrested in 2002; at his bail hearing his wife and children were believed to be overseas at this time( BECAUSE that is where he lived after giving up his citizenship) According to court records in Florida, he was divorced from his wife of five years, Cherie Maria Stultz, in March 2001. The pair married January 2, 1996. She filed for divorce, describing the marriage as "irrevocably broken," and placed an ad in a local business newspaper in January 2001 serving notice she was seeking divorce. Broward County court records also show that on July 1, 1994, Padilla changed his name to one word: "Ibrahim." He was married under that name, and divorce papers identify him as Jose Ibrahim Padilla."[3]

According to press reports in 2002 Padilla had been in the Afghanistan-Pakistan region in 2001 and early 2002.Padilla alleged to have been trained in the construction and employment of radiologic weapons -- "dirty bombs" -- at an al Qaeda safehouse in Lahore, Pakistan. Padilla and United Kingdom resident Binyam Mohammed were alleged to have been recruited to travel to the USA to launch terrorist attacks, at the Lahore safe house.

Padilla traveled to Egypt, Saudi Arabia, Afghanistan, Pakistan, and Iraq. On his return, he was arrested by federal agents at Chicago's O'Hare International Airport on May 8, 2002, and held as a material witness on a warrant issued in the state of New York stemming from the September 11, 2001 attacks.

We will never know all the truth about this guy, but he is why I say we need to create and entire new law dealing with this issue. When one wants to attack the US they are committing treason and they are an enemy combatent. Not an easy issue I agree, but lets face it, setting off a dirty bomb is a little more than a felony.

Reality Bytes (author) from Freeman On The Land United States of America. on December 30, 2011:

José Padilla (born October 18, 1970), also known as Abdullah al-Muhajir or Muhajir Abdullah, is a United States citizen convicted of aiding terrorists.

Padilla was arrested in Chicago on May 8, 2002 on suspicion of plotting a radiological bomb ("dirty bomb") attack. He was detained as a material witness until June 9, 2002, when President George W. Bush designated him an enemy combatant and, arguing that he was thereby not entitled to trial in civilian courts, had him transferred to a military prison. Padilla was held for three and a half years as an "enemy combatant" until, after pressure from civil liberties groups, the charge was dropped and his case was moved to a civilian court.

I am not saying that this individual was guilty or not. I am just presenting the case that American citizens have been detained in such a manner. The situation was rectified but no thanks to the Federal Government or the Bush Administration!

Reality Bytes (author) from Freeman On The Land United States of America. on December 28, 2011:

AV why enemy combatant, why not call them prisoners of war. You do realize when we went in to Afghanistan we offered rewards for the locals to hand over foreigners. Thus the system was abused and the Afghani villagers "sold" any foreigners to the Americans for the reward.

No evidence that any of these people posed a threat to the United States, no evidence, no TRIAL. not even a chance to speak to an Attorney.

Why do these "enemy combatants" have no trials ever. Nuremberg set a precedent for handling exactly these situations yet the Federal Government has oppressed these detainees who is quite possible innocent of any wrongdoing.

The term "enemy combatant has been placed on American citizens captured within the boundaries of their Nation. The Government does not have the power to ignore the Constitution and hold these people in perpetual incarceration without showing evidence in some way?

As to the "terrorist" term, you are right it can be abused, but the people in Gitmo while terrorists, are actually labeled enemy combatents and therefore that makes them POWs of war and yes they do not get the rights afforded a court system. But if it is found that they commited a war crime, they are entitled to a military trial.

It takes me back to there needs to be a specific breakdown on what means what and exactly what will happen.

poetvix The blanket label "terrorist" can be manipulated to include anyone the Government feels is a potential future threat. Since when can someone be guilty of a crime that has not been committed yet?

Once labeled a "terrorist" a person is held without being charged. No charges, no access to Attorneys. No Attorney, no one has standing to submit a writ of habeus corpus. If the person ends up in Guantanamo Bay the Federal Courts claim to have no jurisdiction since it is outside the borders of the United States.

Outside the borders of the United States? I wonder where in the Constitution it says that a human beings Rights end at a "border"?

It is tyranny, it is a system of total control. It is designed to instill FEAR in any potential Government dissension. It is in fact an act of "terrorism" in and of itself. The Constitution does not provide a human being with Rights, the document simply lays out those Rights that a human being possesses at birth. The Constitution is designed to restrict Government!

Please share your thoughts and ask the same of those you speak with. Through an educated and aware population this can all be stopped and turned around.

I see this use of the fear of terrorism and the march towards fewer and fewer freedoms as a conditioning tool to further oppress us. I thank you for a most mentally stimulating Hub and I'm including the above comments, all of the comments, in that statement. You know my comments are always civil, we may not agree but that is why we have opinions LOL. I know you followed another discussion I had with someone and I was civil despite being called a liar and ignorant.

You are right, I will admit 911 is a very personal day to me, even more now that I almost died last December from it's effects. While I do not have a blind eye I will defend those who make untrue statements. An opinion is one thing but I will not allow anyone to desicrate the memory of anyone who died that day.

You are right, terroist is a label, so is a bank robber, a rapist. I will not disagree that the Presisdent and Congress abuse and not follow the law, or even have different interpritations of our Constitution. It is truly amazing. Martha Stewart goes to prison for the same thing Pelosi and Boehner both admit to doing but make excuses for it.

This is by far the laziest Congress ever. Upon reflection, I think it is because both sides did not want to make headlines last year heading into the election year. So they waited till the last moment and they became huge news stories anyway. Perehaps just one time instead of running on blame, they could run on accomplishments. What a novel idea.

As for McViegh I do not believe he was a government agent, but I do believe he had an aganda to prove himself for some reason. Some say for a Militia, some say he hated the service and wanted revenge. Unelss he was here to tell us we will never know.

As for your hubs, I would not say they are controverial. If you were I suspect you would get sensored as much as I do. LOL I always enjoy reading someone elses opinion because it helps me to understand why and how people think. I to do alot of research as you know, despite some typos from time to time LOL. But I to believe in discussions, but it is easier to do so with some more than others. Let's keep talking and Peace to you as well.

AV, it will be abused. That is the nature of mankind. To test limits. The word "terrorist" is a label. Not a true trait of mankind. If it means anyone who would cause terror in the population, then by definition most of our government are terrorist organizations.

The Presidential powers now exceed those held by King George III prior to the American revolution. The Executive in Chief who has taken an Oath to uphold the constitution has instead ripped it in shreds..TRAITOR!

Congress cannot agree on anything without a "sky is falling crisis" running 24/7 over the media waves. This was an exception. Something the majority agreed with instantly...TRAITORS.

All the while the Media followed around a candidate to see if he made passes at women fifteen years ago. This would never had passed had the Media done its job and disclosed this Bill to the American people in the same details they covered Lewinsky/Clinton.

I enjoy history and cannot but notice the coincidences. Nazi Germany came to power in an almost horizontal rise to power as our NEW tyrants have, all that is needed is the disarming of the majority of the population which has been a continuous plot for years. "The Reichstag has already been burned by the Communists" The propaganda machine is almost fully operational...once the internet is reined in and discussions like this will result in arrests.

YES, I am comparing 9/11 to the Reichstag fires. I know you have a very personal attachment to that day and I apologize if I offend you. I commend you for your service!

I am sorry but that does not sway me from my opinion that the entire day was a "False flag"...If it makes a difference I think Timothy McVeigh was an agent of our Government or at least he thought he was one. If not then he was a patsy used by agents of the Government. In the same way they entrap potential terrorists today. They work a suspect for years until they get them to agree to commit an atrocity. The Agents of the Government supply the plans and the logistical support right up to the time that the atrocity is to be committed. then they make the arrest on a crime that they have fully conspired in...or in Oklahoma city they make no arrest and provide a working functional weapon of mass destruction.

Problem + Reaction = Solution It has been used many times throughout history to enable the Elite to get exactly what they had wanted all the time.

Can OUR Government break Laws they are sworn to uphold? Does the Council of foreign Relations make up an unaccountable, unelected, secret government operating outside the confines of Constitutional Law? What is it that is discussed within a Bilderberger meeting and if it is not nefarious, why is the contents of the meeting not opened up to the light of day?

As you can tell i am not shooting from the hip when writing these controversial hubs. I have done many hours of research over many years. I can thank the Mass murdering Attorney General Janet "the babykiller" Reno for opening my eyes. It was under her watch that I realized the Government is quite capable of breaking Laws and murdering its own citizens.

Well my comment has almost reached hub size AV, I thank you for reading my hub and placing a comment. If civil I will always post any comments to my hub. I thank you for the Service you have done, the sacrifices you have made and the intent behind your postings. Peace Brother... through civil discussion we can change the world!

"There is no legel defenition of suspected terrorist"

That one sentence sums up the point I have been trying to get people to understand. This is a crime on an entirely different level, in my opinion a military issue. If the first World Trade Center Bombing and 911 does not show the people that the US is a battleground too, then show me what it will take for those to believe it. This is not war as people know it. There are no fixholes, no bounderies or fighting zones. This enemy will strike anywhere at any time.

The problem with capturing them here and trying them in our courts will only encourage them to come here of even become citizens(as some have) to get the protections we deserve. I am sorry, they do not deserve them. I wrote an article on Gitmo and what it should be if you would like to go read it.

I started to write an article about the law most people say take away our rights and I deleted it when the bill was signed. I broke down exactly why the hype was blown out of proportion. My problem is it is too broad and abuse is possible, plus it should not have been in an appropreations bill. There should be an in depth bill breaking the whole thing down and how to address the issue.

Hello, Reality Bytes,

Awesome, very interesting and thought-provoking post.

Based on my observations, a considerable number of Americans are nearly begging to be ruled by a police state.

There are calls for the military to patrol the inner-cities, many are out there clamoring for more "police protection," and many of the publc schools have become "quasi-prisons."

And many Americans have either forgotten or have never been aware that government is not supposed to be in charge of us -- We, The People are supposed to be in charge of government.

Reality Bytes (author) from Freeman On The Land United States of America. on December 10, 2011:

AV should I be arrested for posting hubs such as this? Am I a domestic enemy. I love my Country but I despise our central Government.

I agree "enemy combatants" should fall under military jurisdiction. On the grounds of this Nation, normal Courts and Laws should suffice. Anyone arrested within the borders of the United States or it's terrotories should be tried under common law. While those captured during combat in a WAR zone should be tried under Military Tribunals.

There is no legel defenition of suspected terrorist, so anyone the Government fingers is guilty simply because some bearucrat said so.

Also in no way would I be willing to give up my freedoms for a feeling of safety. Especially when that security is nothing but theatrics.

American View from Plano, Texas on December 10, 2011:

Happy to assist you in achieving your goal LOL.

Obviously there is a major difference in attacking the US or being a traitor, and that of molestation. That is my point exactly. There are many different crimes and they are on different levels. Felonies, Misdameanors are different for a reason. Being a traitor or attacking the US does not fall uinder either category as far as I am concerned. That is why I am against bring the terrorists from Gitmo to the US for a trial in our courts giving them the same rights you and I have. Terrorism and the like need to be in a separate defined category. Since the action is an attack upon the US no matter where it occurs, that is a definition of war, to be attacked. Hence why I think they need to be tried in a military trial and under those rules. That is what the constitution guarantees.

Just a note, if you do not think the streets of America are off limits to being a battleground, I guess the terrorists missed that memo

Reality Bytes (author) from Freeman On The Land United States of America. on December 10, 2011:
