Employment and Labor Laws in GCC Countries

GCC which is constituted of six countries is a single largest block for expatriate employment. These are the rich countries and single largest exporter of oil and gas in the world. GCC consists of Qatar, Kuwait, Saudi Arabia, Bahrain and Oman. Saudi is world’s top rank oil exported and Qatar is way ahead in gas. These countries are fully dependent on expatriate workers for the skilled and non-skilled jobs.

Kingdom of Saudi Arabia is biggest of all countries. The KSA population is 27 million of which almost 18 million or 70 percent are Saudi’s and 30 percent or 9 million or less are expatriate population.

UAE is second biggest by population in GCC. As per data available the UAE population is almost 8.6 million people of which 90% are expatriates. In term of economy also, UAE is second biggest economy of the region and transshipment hub.

Kuwait is third biggest country with 3.3 million population of which 1.1 million or 33 percent are Kuwaiti’s and 66 percent are the expatriates. Kuwait is one of the biggest oil exporter in the world and economy is basically driven by oil.

Oman is relatively poor of all countries with around 3 million populations. It is not a big exporter of oil and its position is more coming from mines and mineral industry. Nationalization is highest in Oman.

Qatar is around 1.5 million population. The economy and population is fastest growing. Qatar is fast growing state which has known fast going after big sporting event. Qatar was the first Middle East country to host Asian games in 2006 and will host FIFA world cup in 2022. Qatar is biggest exporter of gas in the world.

Bahrain is smallest of all with around a million or less in population. Financial sector along with oil and gas plays important role in growth of Bahrain.

These are the rich countries with Qatar standing as second richest in the world as per the IMF 2011 data with more than $ 100,000 per capita income, others are not far behind with UAE the world rank 4 and then Kuwait, Saudi and Bahrain.

Employment and Labor Law

There are two categories of the visas, employment visa and house work visa (maid visa) and farming visas. Domestic workers and farming workers are not part of labor laws. Employment visa is issued to companies and establishments and house work visa are issued to the every family. Every local family is issued five visas for house work but they can apply and get more visas issued for some payment.

Employment visa is issued based on the size of company and its capital. Every local can establish and business enterprise and can get visa, these may be big companies or may be small shops. The law always favors owners.

The underlying principle of GCC countries is “hire and fire”. GCC countries have failed to establish internationally acceptable standards for migrant workers. Most GCC countries’ labor and immigration laws facilitate and validate inhuman treatment towards migrant workers. These laws are abusive, and as a result they control, restrict, and infringe on all internationally accepted standards of “fair dealing” towards millions of migrant workers. Employers frequently withhold wages for months and confiscate passports as “security” to keep workers from quitting. The combination of “recruiting fees” and abusive work environment constitute “forced labor” in this region.

Khiraj – Exits Permit – Except Kuwait and UAE all other countries needs permission of employer to leave the country. Even if the employee has his passport he needs permission of the employer so that he can travel abroad.

Sponsorship – This is system where if employee wants to change his job and join another job he need the permission from his present employer or change it. Unless and until permission is granted jobs cannot be changed. Transfer of sponsorship is allowed in restricted categories only. The issues affecting expatriate workers in the Gulf region are different from the migrant population in other regions of the world. The most important difference is the “temporary status” of the expatriate workers in the Gulf countries.

Trading in Visas – This one more phenomenon where local national provide to the expatriate worker and takes a fixed charge every year. He is not responsible for any thing of the worker. Local nationals establishes companies may be fake or real and sale these visas. A worker buys visa and is self-employed.

Salaries– I will divide it into marginal labor, blue collar jobs and white collar jobs. The marginal labor is one of most exploited class of workers. ( ALL Wages and Salaries are monthly basis)

The marginal labor – Cleaning company workers and construction workers along other marginal workers are highly exploited class. They paid least between USD 150 to USD 250. The wages are very irregular. Sometimes they are delayed for six months and sometime never paid. These are highest number of workers. Those who work in small shops are usually paid USD 250 to USD 500 depending upon working hours. Cost of living is very high. 20 to 30 marginal workers live in single apartment of 2 bedrooms. (700 sq. ft. – 850 sq. ft.) Saving is very difficult in this situation.

Blue Collar Jobs – These are the jobs of companies or self-employed. They are paid USD 750 to USD 1750. In this category the heavy and super heavy drivers and all kinds of mechanics and machinist are in demand. Their exploitation is relatively less than the marginal workers.

White Collar Jobs – These are best jobs, usually offered by good companies or relatively better one. Accountant, engineers, doctors, and investment banker are the best profession. Teaching is good option but salaries of the school teachers are not lucrative enough. College and university professors are senior or retired professors of Europe. They are most in demand at university level. They are available relatively at less cost compared to young professionals.

The salary structure varies a lot. A fresh accountant start with USD 700 to USD 800, experienced CA, CPA, CMA depending upon qualification and experience gets between USD 2000, Chief Accountant, Finance Managers, AVP and VP can fetch USD 3000 to USD 10000 and above. CFO can get up to USD 10000 to USD 20000 per months.

Engineers are the second in demand. Construction is one of the most important industry of the region and has very important role to play.

The best industry to work is Oil and Gas. This is the industry is at core of the wealth of the GCC region. It is best paying industry in the region. These are Government owned industry or subcontractor to the industry.

The other best industry in this region is banking and investment. This is one of shining industry in this region. This region is wealthy region and you need wealth managers. This industry has always done great. This is best industry as pay master. A salary varies from USD 5000 to USD15000 for senior managers.

House Work Visa – Maids and Agriculture Labor

This is most exploited class of workers. They work in homes or they buy it and work outside. Every national family gets five such visas. They can get some more by paying nominal extra money to the government. This class of workers does not covered by labor law.

Hello. I was working in UAE in one company for a year, then I resigned and worked my notice period, but company didn't cancel my visa and make a labor complaint on me. I left UAE without visa cancelation and having labor complaint . I'm home 2 month. Can I apply for a work in other GCC countries now, would I have problems with visa. Thank you

Sir, i have debts in Dubai. After my mom died. I found out that all the money I have been sending her is kept in the bank. I now have her money. I want to pay my debts, but i want to pay little by little as I do not have stable work yet. Can banks in UAE freeze my account here in Philippines? How true are those people testifying that they have problem to enter and work again in another GCC if they have unpaid bank loan and credit cards in one GCC? is it a hoax? or depends on the amount? or case to case basis?

I am previously working at KSA way back 2013 and left an unpaid loan of 43K rials and CC amounting to 10K rials and then after they terminated my employment due to undue extension of my vacation leave. I am trying to explain but they terminated my employment. Now one agency here in Philippines invited me to submit my cv to work in UAE and the other is in Qatar.

Now, there is this collection agency asking me to settle my obligation with the bank. I told the collection agency that I will settle my outstanding payment once I landed again for a job to other GCC countries.

My question is can I still work in qatar/UAE or other gcc despite I have unpaid loan and cc in KSA?

GCC in joint push to block tainted expatriates’

In yet another move to cut reliance on foreign labor, the six-nation Gulf Cooperation Council (GCC) is working on a joint database project that will contain comprehensive information about tainted foreign workers.

The plan is aimed at preventing the entry of a foreign worker into any Gulf country, if proof is found of his criminal involvement in his previous country of residence.

“The project is subject to clearance from the ministries of labor and interior of the GCC countries,” said a GCC source, Saturday. He said the details of the database and the mechanism to follow were discussed by the GCC labor ministers’ meeting held in October last.

@Sameer - If you are defaulter in Dubai, then Mumbai agent can not harass you. Just register a case against them at Mumbai Cyber Crime Branch of harassment. Legally they can not do anything to you in Oman or Bahrain. If they call take their Name, Phone number and address, all details and file a complained against them.

I got a called from the recovery agent in mumbai yesterday , i didn't speak to them just cut the call. then i looked at the job portal and saw that the agent looked at my profile. then i delete the entire profile and removed all my details. Folks, you have received many comments from Zia brother, that we can go to other Middle East or GCC countries, even if one particular nation has put a ban or court case against you.

My only concern is has anyone of you faced any difficulty after going to that different country. Though I have full faith in Zia brother's responses, still I wish to know from the real people who had experienced this.

May I ask how true is the rumor going around that expats from one GCC country cannot enter another country in GCC if he/she has deported from one of the GCC countries? They said the new law is based on GCC security pact? I am particular to the case of being deported from Dubai due to absconding case and now planning to visit Kuwait soon.

I got a job offer in Qatar and my employer they applied my work visa but it is rejected because of my name is in blacklist. is that possible i never beet to Qatar before ? Please advise how could i solve this issue, i really don't want to miss this offer.

This is true if you have given them check, check bounced case is different. Secondly, he can fight it in Court and specially in home country he is at advantage. He can also declare bankruptcy. It is not possible to arrest and send from home country, even the local default and check bounce will take 20 years to close the case. Just take a legal process. No one can be deported from India, Pakistan , Bangladesh and Philippine ( nationals) for their default in third country and they have all legal ways to fight it in court. In western country they can declare bankruptcies. This article is just to frighten . Legally Qatar court can not deport him to third country except for Organised Crime, Terrorist activity, drugs and serious fraud. One should hire a good lawyer to fight a case.

@ Then amount can not go that much, after one year of default it stopped increasing, this the law. Go legal against them. Let them file a case in UAE, they can not do anything here. What they are doing is illegal and they can be arrested in Qatar.

@rosh werain - they can not arrest you in Qatar. If your HR is good then they can not do anything to you. If they are coming, talk to local lawyer, take their Phone Number, ID's and file a police complained against them. Legally they can not. What they are doing is just illegal. If your HR supports you, they will be in jail in no time. Legally they can not do it in Qatar for your dues or defaults in UAE. Talk clearly to HR and your boss and also to lawyer. If HR and your boss supports you, they can go directly to jail from your office.

dear sir,i need ur quick response again im here in qatar right now..its been 2 yrs almost but recently someone called me on qatar lanline number and mobile as well he said i have to pay 21000 dhs to abn amro dubai bank...i guess this numbers belongs to qnb{qatar national bank} now he send me masage and mention if i not response to them they will make a legal issue{tahseel legal},,i know this credit card i took in 2006 when iwas in dubai the limit was only a 5000dhs now with the amount 21000 but i have no money to pay them ...sir what i should do how this will affect to me when im in a different country,,,are they already linked...please reply me its urgent...coz i didn't pick up his call i want to ask u first,,,

@rosh werain - ask him, who is he. If he does not reply, with his name and other details, don't reply. Just file a police complaint with police on the number from which you are receiving call. QNB has nothing do to with your UAE account. The card amount do not multiply as you stopped paying, it can not be compound interest, so you are only liable to pay card limit and interest for first year, i.e. when you stopped paying. It will never go to 4 times, these are illegal agents who harass poor people, if you go to Police, he will stop calling you.
